The Supreme Court spoke its mind on the need for sub-categorisation of SC, ST and BC reservations. Noting that there are many inequalities in the list of castes, it observed that the fruits of reservations are not reaching some of the deserving beneficiaries. It has recognized the power of state governments in making changes in reservations according to the status and condition of castes in their respective states. Intellectuals and supporters of sub-categorisation welcomed the move which will eradicate injustice in ensuring benefit of reservations to all castes equally. However, it is likely that the latest development may cause some discomfort to YS Jagan.
Tightrope walk
Observers say that Jagan may face severe political problems if he goes for sub-categorisation of reservation. Malas have been backing YSRCP since its inception and contributed to its ascent to power. They have been opposing sub-catogorisation tooth and nail. If Jagan acts in favour of Malas, it will lose whatever support it has among another SC sub-caste Madigas, who have been mostly supporting TDP which earlier tried to categorise SCs into A, B, C and D. Madigas now want the government to carry out the categorization process as the government cannot cite objections from judiciary. Naidu’s government in 2000 attempted sub-categorisation for the benefit of Madigas, but it was shot down by courts.
The latest Supreme Court decision puts the ball in states’ court. At least, legally there are no roadblocks if the state government wants to categorise SC and ST reservations. The apex court delved on the need for creamy layer in SC, ST reservations as only few castes are enjoying the fruits for decades, leaving others in the lurch. If Jagan decides to implement the creamy layer system, he will lose many votes.
If the state government wants to take up categorization within SC and ST castes, it has to study the social, financial conditions of various castes. It has to ensure equal justice to all. A wrong step will inflame discord and discontent between different castes. Already opposition, SC and ST leaders are demanding the state government to take up categorization in accordance with the Supreme Court decision. If Jagan goes for sub quota, it will infuriate Malas and if he does not, Madigas will agitate.
